Lemon Drip Catering Terms & Conditions

By booking catering services with Lemon Drip, LLC (“Lemon Drip”), the customer (“Client”) agrees to the following terms and conditions.
1. Booking & Deposit
A 25% deposit is required to confirm and reserve your event date and time.
Submitting an event request or providing payment information does not guarantee availability. Lemon Drip will review the requested date, location, staffing, and event details before confirming the booking.
Once Lemon Drip confirms the event, the 25% deposit will be charged to the card on file and the event will be considered officially booked.
If Lemon Drip is unable to accommodate the event, the card will not be charged.
The deposit is applied toward the total event balance.
2. Final Payment
Unless otherwise stated in writing, the remaining event balance must be paid prior to the scheduled event.
Client authorizes Lemon Drip to charge the remaining balance to the payment method on file according to the payment schedule provided with the booking.
Any approved additions, additional service time, increased guest counts, special requests, venue charges, or other additional costs may be charged separately.
3. Guest Count & Catering Package
Pricing is based on the guest count, service time, menu, location, and other event details provided at the time of booking.
Client must notify Lemon Drip as soon as possible of any significant increase in expected attendance. Increased attendance may require additional product, equipment, staffing, or service capacity and may result in an additional charge.
Lemon Drip cannot guarantee service for attendance substantially exceeding the contracted guest count unless arrangements have been made in advance.
Reducing the guest count after booking does not automatically reduce the contracted event price.
4. Catering Price & Actual Consumption
The catering price reserves Lemon Drip's staff, equipment, inventory, preparation, travel, and service capacity for the contracted event.
Pricing is not based solely on the number of drinks actually consumed.
For example, if Lemon Drip is contracted to provide service for up to 150 guests, the Client is purchasing and reserving the capacity to serve that event—not purchasing individual drinks on a pay-per-consumption basis.
No refunds or credits will be issued because fewer guests attend than expected or because fewer drinks are consumed than anticipated.
5. Service Time
Service will be provided during the time period stated in the event agreement.
Lemon Drip will arrive with sufficient time to complete normal setup before the scheduled service time, provided reasonable access to the event location is available.
Requests to extend service beyond the contracted end time are subject to staff availability, inventory, venue restrictions, and additional charges.
Lemon Drip is not obligated to continue service beyond the contracted service period.
6. Setup & Event Access
Client is responsible for providing Lemon Drip with reasonable access to the event location for setup, service, and breakdown.
The designated service area must be reasonably level, safe, accessible, and suitable for Lemon Drip's equipment.
Client must notify Lemon Drip in advance of unusual access conditions, including stairs, elevators, long-distance load-ins, restricted parking, security checkpoints, limited setup windows, or other circumstances that may affect setup.
Additional charges may apply when extraordinary setup, transportation, parking, or labor is required.
7. Venue Requirements, Permits & Restrictions
Client is responsible for informing Lemon Drip before the event of any venue-specific rules or requirements that could affect Lemon Drip's operation.
This includes, but is not limited to:
- Certificates of insurance or additional insured requirements
- Vendor approval requirements
- Health or temporary food-service requirements
- Fire or safety requirements
- Loading and unloading restrictions
- Parking fees
- Vendor fees or commissions
- Power restrictions
- Water restrictions
- Setup limitations
- Service restrictions
- Required arrival or departure times
Unless specifically included in the catering agreement, unexpected venue fees, commissions, parking charges, permits, or similar costs imposed on Lemon Drip may be added to the Client's balance.
8. Menu & Product Availability
Lemon Drip will make reasonable efforts to provide the flavors, menu items, and service options selected for the event.
Occasionally, ingredients, products, equipment, or supplies may become unavailable due to circumstances outside Lemon Drip's reasonable control.
When necessary, Lemon Drip may make reasonable substitutions while maintaining a comparable level of service and product quality.
9. Cancellations by Client
Because Lemon Drip reserves staff, equipment, inventory, and event capacity specifically for each catering event, cancellations are subject to the following policy:
More than 14 days before the event: The Client may cancel the event. The 25% booking deposit is non-refundable but may, at Lemon Drip's discretion, be transferred once to another available event date occurring within 12 months.
7–14 days before the event: The 25% booking deposit is non-refundable. Any additional amounts paid may be credited toward a rescheduled event at Lemon Drip's discretion.
Less than 7 days before the event: The full contracted event amount is due and non-refundable.
These terms reflect the staffing, scheduling, purchasing, preparation, and other commitments Lemon Drip makes in preparation for an event.
10. Rescheduling
Requests to change an event date are subject to Lemon Drip's availability.
A rescheduled date is not guaranteed until Lemon Drip confirms the new date.
When sufficient notice is provided, Lemon Drip will make reasonable efforts to transfer payments to the rescheduled event.
Changes requested within 7 days of the event may be treated as a cancellation and new booking.
Pricing may be adjusted if the new date, location, guest count, service requirements, or other circumstances differ from the original booking.
11. Weather
Lemon Drip operates many outdoor events and will make reasonable efforts to provide service during normal weather conditions.
However, Lemon Drip reserves the right to delay setup, temporarily suspend service, modify operations, relocate equipment, or cancel service when weather or environmental conditions create an unreasonable safety risk to employees, guests, vehicles, tents, trailers, electrical equipment, or other property.
Unsafe conditions may include, but are not limited to, severe thunderstorms, lightning, high winds, flooding, extreme temperatures, hazardous road conditions, or government-issued weather or emergency warnings.
Weather-related decisions involving the safety of Lemon Drip employees or equipment will be made by Lemon Drip.
If weather causes the Client to cancel the event, the standard cancellation policy applies.
If Lemon Drip determines that it cannot safely provide service, Lemon Drip will work with the Client in good faith to reschedule the event or provide an appropriate credit based on the circumstances and costs already incurred.
12. Force Majeure
Neither party will be considered in breach of the agreement when performance becomes impossible or commercially unreasonable because of circumstances beyond that party's reasonable control.
Such circumstances may include severe weather, natural disasters, fire, government restrictions, public emergencies, utility failures, road closures, transportation disruptions, civil disturbances, or other extraordinary events outside the reasonable control of the affected party.
If a force majeure event prevents Lemon Drip from providing the contracted service, Lemon Drip and the Client will make reasonable efforts to reschedule the event.
Amounts already spent or committed specifically for the event may be deducted before determining any available credit or refund.
13. Delays Outside Lemon Drip's Control
Lemon Drip is not responsible for reduced service time caused by circumstances outside its reasonable control, including Client delays, venue access problems, security delays, incorrect event information, venue restrictions not disclosed in advance, or other conditions preventing Lemon Drip from beginning service as scheduled.
When Lemon Drip is ready and able to perform but service is delayed because of the Client or venue, the contracted service period will generally remain unchanged unless Lemon Drip agrees otherwise.
14. Unused Product
Products, ingredients, supplies, and inventory brought to an event remain the property of Lemon Drip unless specifically included as individually packaged items in the catering agreement.
Unused ingredients or beverages do not create a refund or credit.
For food-safety, quality-control, operational, and liability reasons, Lemon Drip determines whether unused prepared product may be provided to the Client at the conclusion of the event.
15. Staffing & Operations
Lemon Drip determines the appropriate staffing level, equipment configuration, service process, and operational setup necessary to fulfill the event.
Specific employees are not guaranteed unless expressly agreed to in writing.
Lemon Drip may make reasonable operational changes when necessary while maintaining the overall contracted service.
16. Damage & Safety
Client agrees to provide a reasonably safe environment for Lemon Drip employees and equipment.
Client may be responsible for damage to Lemon Drip equipment caused by guests, attendees, Client representatives, or venue personnel when such damage results from misuse, negligence, intentional conduct, or circumstances under the Client's reasonable control.
Lemon Drip reserves the right to discontinue service if employees are subjected to threatening, abusive, dangerous, or unlawful behavior.
17. Card on File & Authorization
By providing a payment method, Client authorizes Lemon Drip and its payment processor to store the payment method and charge amounts due under the confirmed catering agreement, including:
- The booking deposit
- The remaining contracted balance
- Client-approved additions or upgrades
- Approved additional service time
- Additional charges resulting from requested changes to the event
Lemon Drip will not charge amounts unrelated to the Client's catering agreement.
18. Changes to Event Details
Changes to the event date, location, guest count, service time, menu, setup requirements, or other material event details must be approved by Lemon Drip.
Changes may affect pricing.
Verbal requests are not considered modifications to the agreement until acknowledged by Lemon Drip.
19. Limitation of Liability
To the fullest extent permitted by applicable law, Lemon Drip's liability arising from the catering agreement will not exceed the amount actually paid by the Client to Lemon Drip for the applicable event.
Lemon Drip will not be responsible for indirect, incidental, special, or consequential losses resulting from circumstances outside Lemon Drip's reasonable control.
Nothing in these terms limits liability that cannot legally be limited under applicable law.
20. Governing Law
These Terms & Conditions and the associated catering agreement are governed by the laws of the State of Utah.
21. Entire Agreement
The confirmed event proposal, invoice, booking details, and these Terms & Conditions collectively constitute the agreement between Lemon Drip and the Client.
If special terms are included in a written proposal or event agreement, those specific terms will control if they conflict with these general Terms & Conditions.
22. Acceptance
By submitting the booking, approving the event proposal, paying the deposit, or otherwise authorizing Lemon Drip to proceed with the event, Client acknowledges that they have reviewed and agree to these Catering Terms & Conditions.
